Please read the terms and conditions set out below carefully before ordering any goods or services from this website. By ordering any goods or services from this website you agree to be bound by these terms and conditions ("Terms & Conditions").
"you", "your" and "yours" are references to you the person accessing this website and ordering any goods from the website.
"we", "us" and "our" are references to The Dutch Connection, trading as thedutchconnection.co.uk.
"Delivery, Cancellation and Returns Policy" means the policy displayed on our website for the delivery, cancellation or return of goods or services.
2.1 We aim to make ordering from us as simple and straightforward as possible. Orders can be placed online via the website. Once your online transaction has been completed your order will be confirmed by email. The Dutch Connection currently accepts Visa, MasterCard, Meastro and Bank Wire Transfers.
2.2 Made to order items can also be ordered upon request by email. After receiving your order we will contact you to discuss your requirements. Once we have received your signed agreement and payment is taken, your order will be processed. Please note that we are unable to change an item after it has been entered into production
2.3 Any contract for the supply of goods or services from this website is between you and The Dutch Connection. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of ordering. You also warrant that the credit or debit card details that you provide is your own credit or debit card and that you have sufficient funds to make the payment.
2.4 Goods and services purchased from this website are intended for your use only and you warrant that any goods purchased by you are not for resale and that you are acting as principal only and not as agent for another party when receiving the services.
2.5 We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.
2.6 Any order that you place with us is subject to product availability and acceptance by us.
2.7 The contract for the goods or services will be accepted at the time of despatch of your order. We will confirm this to you in writing. You must inform us immediately if any details are incorrect. If your order has not been accepted you will be notified of this in writing together with the reasons.
3.1 All prices listed on the website are correct at the time of publication however we reserve the right to alter these in the future. Prices are inclusive of the relevant sales tax but exclusive of delivery charges which will be added to your order.
3.2 The total price for goods or services ordered, including delivery charges, will be displayed on the website when you place your order. Full payment must be made before goods are despatched or services provided.
4.1 We make every effort to ensure colours appear as realistic as possible. However due to the constraints of digital reproduction on different web browsers, we cannot guarantee exact colour depiction. Please be aware that the colour you see on the screen may differ to the actual colour of your ordered products.
4.2 For all items made from natural products, such as leather or wood, there may be variations in the colour, shade, pattern or finish from those on the website due to the inherent nature of these products. We cannot guarantee an exact match for goods which have been ordered at different times.
4.3 Every care is taken to ensure descriptions and measurements are accurate, however variations may occur. Packaging may vary from that shown.
5. Our Website
5.1 The information, content and material available on the website may vary from time to time without notice to you. This is in order to ensure that the website is as up to date as possible.
5.2 We aim to have the site available at all times, however, you will appreciate that we cannot guarantee this or that it will be error free and we cannot accept liability for any issues that this may cause. We aim to keep the website as up to date as possible; all product descriptions displayed on the website are correct at the time the information is entered however the information appearing at the time may not always reflect the position exactly at the time you place your order.
5.3 You must not interfere with the working of our website nor must you circumvent security on the site, tamper with, or hack into, or otherwise attempt to disrupt our computer system, server, website, router or any other internet connected device or service.
6.1 Delivery will be made as soon as possible after your order is accepted dependant on the lead time of the product. Delivery periods quoted at the time of ordering are approximate only and may vary.
6.2 All deliveries will be between Monday to Friday during the hours of 8am and 6pm. Should you wish for your order to be delivered at a specific time or on a Saturday, please let us know when placing the order or send us an email at email@example.com quoting your name, order reference and preferred date. Please note that additional costs will be incurred for specified time deliveries.
6.3 Standard items will be sent by recorded delivery or courier despatch and will therefore require a signature upon receipt. Goods will be delivered to the address nominated by you at the time of ordering.
6.4 Please note it may not be possible for us to deliver to some locations. Should delivery time be delayed we do not accept liability of any consequential loss. We will contact you if there is a delay or items are out of stock.
6.5 The delivery of big/heavy items like sofas, tables, hot tubs or stoves is kerbside and does not include assembly or unpacking. Occasionally the delivery company may require assistance unloading larger items. However, with prior agreement, Iconic Dutch is able to offer an on-site installation service. The cost is subject to the size of the item and the delivery location. If you would like a quotation in advance, please email firstname.lastname@example.org.
6.6 All shipping costs are calculated by weight and territory. The Dutchtub and Outdoorovens from Weltevree incur a special delivery charge due to extra care required for delivery.
7. Overseas Purchasing
7.1 Shipping costs are calculated depending on the country, size, weight and quantity ordered. If your country is not listed please email us with the delivery address and the items you wish to order and we will provide a quotation.
7.2 Where delivery is outside the UK, you may be liable to pay additional tax or duty once the goods reach your country. This may vary from country to country. Please contact your local customs office for more information.
7.3 Please note that goods may be subject to inspection by your local customs office where delivery is outside the UK.
7.4 Please be aware that due to the high cost of shipping internationally, the cost of delivery and return is not covered by Iconic Dutch under any circumstances so therefore purchases are entirely at your own risk.
8. Cancellation & Returns Policy
8.1 If you wish to cancel your order you must let us know within 24 hours after placing the order. To cancel your order you must notify us in writing to email@example.com quoting your name and order reference. Once we have received your confirmation that you wish to cancel your order we will refund the full amount including the cost of delivery. We cannot guarantee that we will be able to stop your order once we receive notice of cancellation as the goods may already have been despatched. In these cases, you will need to return the goods in accordance with our Returns Policy.
8.2 If you have received the goods after you cancelled your order then you must send the goods back without unpacking them to us at your own cost and risk.
8.3 Under the Consumer Contracts Regulations, if you buy online or by phone you are entitled to return the item for a refund or exchange within 14 days days from receipt of the goods, with exception of made-to-order products. A made-to-order product is a product which is produced upon order, such as the Dutchtub. If you would like to return your goods or exchange an item for a different item please contact us within 48 hours of receiving your order by email at firstname.lastname@example.org quoting your name and order reference. Any goods returned must be returned in its original packaging, in the condition and packed in the manner of how it was received.
8.4 Returns are at customers' own expenses. We advise you use an insured, signed for service.
Unit 28 Heathfield
Our warehouse in Milton Keynes only handles small items. For returns of large pieces please contact us for a different UK returns address.
8.5 You will be refunded within 14 days after receipt of the returned product in our warehouse. You will be entitled to a full refund of the original cost of the goods provided, with the exception of any delivery charges. The returned goods must be in new and unused condition. New and unused means that there are no marks on the item or any wear on the tags. If there is any indication that the product was used, the item will be returned to the purchaser at their own costs.
8.6 All international refunds will be refunded for the equivalent amount taken in pounds sterling on the original order. Due to fluctuations in the currency exchange rate this may result in a difference between the refunded amount and the original price.
8.7 In order to avoid any trouble, products are verified by The Dutch Connection before their shipment. Please contact us immediately when receiving a damaged or faulty product, to discuss our procedures as detailed below and to organise a replacement.
8.8 Inspect your purchases upon receipt on damages or faults as no claim for replacement can be made after 24 hours of receipt. Any claim regarding items damaged or defective must be made initially by email at email@example.com, followed by a written claim to The Dutch Connection Ltd, 78 York Street, London W1H 1DP. Our team will assess the damage and if approved will order you a replacement or repair (where applicable). The cost of returning the product will be responsibility of the customer who must insure the transit of the product.
8.9 Where damaged or faulty goods are heavy, large or fragile (as determined by The Dutch Connection) we reserve the right to nominate a specialist furniture handler for return transit. The transportation charge for the return will be charged onto the customer each time the customer accepts a returns collection date but then subsequently fails to meet that date.
8.10 We are unable to accept cancellations or returns on goods that have been ordered upon request or have been made to order in a specific finish or upholstery colour, or make a refund or exchange any item that has been entered into production as per the customer's specification. If received damaged or defective then a replacement will be manufactured and delivered as replacement as soon as possible.
9. Cancellation by Us
We reserve the right to cancel the contract between us if we have insufficient stock to deliver the goods you have ordered or we do not deliver to your area. If one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers, we reserve the right to cancel your contract. If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
Where a manufacturer's (or factory) warranty is included, a warranty will be effective only if the consumer who originally purchased the product retains the original sales receipt showing the product specifications and purchase date. If we conclude that your complaint regarding the quality of the delivered goods is well founded, The Dutch Connection will ask the manufacturer to deal with the complaint.
11. Recycling of electrical and electronic equipment
If you're buying a new electrical item, we will recycle your old one for free. The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheelie bin symbol. For each item that is taken away by us there is a standard charge of £15.00.
12. Your Information
12.1 Where we have requested information from you to provide goods or services, you agree to provide us with accurate and complete information.
12.2 You authorise us to use, store or otherwise process your personal information in order to provide the goods or services to you and for marketing and credit control purposes (the "Purpose"). The Purpose may include the disclosure of your personal information to selected third parties from where this is required by law or in order to provide the goods or service to you and for the purpose of processing your order.
12.3 You are entitled to request a copy of the personal information we hold on you. Please contact us at firstname.lastname@example.org if you wish to request this information.
13. Intellectual Property Right
Ownership in, and all rights created in relation to the contents of this website vest in us absolutely unless otherwise indicated. You must not modify, copy, reproduce, upload, post, transmit or distribute by any means or in any manner whatsoever, any material or information or download from our website except where expressly invited to do so or indicated on our website.
14. Linked Sites
There may be a number of links on our website to third party websites which we believe may be of interest to you. We do not represent the quality of the goods or services provided by such third parties nor do we have any control over the content or availability of such sites. We cannot accept any responsibility for the content of third party websites or the services or goods that they may provide to you.

16. Limitation of Liability
16.1 Great care has been taken to ensure that the information available on this website is correct and error free. We apologise for any errors or omissions that may have occurred. We cannot warrant that use of the website will be error free or fit for purpose, timely, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website and we do not make any warranty whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.
16.2 We disclaim any and all liability to you for the supply of the goods to the fullest extent permissible under applicable law. The goods despatched are provided to you for your approval and legal title to the goods only passes to you 14 days after delivery. This does not affect your statutory rights as a consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the relevant goods or services. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising. This limitation of liability does not apply to personal injury or death arising as a direct result of our negligence.
16.3 We do not accept any liability for any delays, failures, errors or omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our website.
16.4 We shall not be held liable for any failure or delay in performing services or delivering goods where such failure arises as a result of any act or omission which is outside our reasonable control such as an act of God or those of third parties.
16.5 The products sold by us are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the website or for any products or services purchased from us.
16.6 We have taken all reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.
17.1 We may assign, subcontract or novate any part or parts of the services or goods that we provide to you from time to time and any part or parts of our rights under these Terms and Conditions without your consent or any requirement to notify you.
17.2 We may alter or vary the Terms and Conditions at any time.
17.3 Payment must be made at the time of ordering the goods or services from us. Failure to pay on time will result in either the cancellation of your order or a late payment charge which shall be calculated as interest on the amount due at a rate of 5% over our bank's lending rate. Interest will be charged on a daily basis from the date of invoice to the date of actual receipt of payment in cleared funds.
17.5 If any term or condition of our agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the agreement shall continue in force without such term or condition.
17.6 These Terms and Conditions and our agreement shall be governed by and construed in accordance with the laws of England and Wales. The parties hereto submit to the exclusive jurisdiction of the courts of England and Wales.
17.7 No delay or failure on our part to enforce our rights or remedies under the agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.
